Leerruimte Zijnsoriëntatie - Ronald van der Lee
Article 1: General
- These terms and conditions apply to all agreements between the Leerruimte Zijnsoriëntatie – Ronald van der Lee, hereinafter called Teacher of Zijnsoriëntatie and the client, hereinafter called student, or third party.
- The Teacher of Being Orientation is bound by and works according to the professional code of the Professional Association of Teachers of Being Orientation.
Article 2: Execution of the agreement
- Student shall ensure that all data, which the Teacher of Zijnsoriëntatie indicates are necessary or which the student should reasonably understand are necessary for the execution of the agreement, are provided to the Teacher of Zijnsoriëntatie in a timely manner. If the data required for the execution of the agreement are not provided to the Teacher of Being Orientation in time or truthfully, the TTeacher of Zijnsoriëntatie is entitled to suspend the execution of the agreement.
- The Teacher of Zijnsoriëntatie is not liable for damages, of any kind, due to incorrect and / or incomplete information provided by the student, unless such inaccuracy or incompleteness should have been known to the Teacher of Zijnsoriëntatie.
- The Teacher of Zijnsoriëntatie reserves the right to deny student participation in a course, training or retreat, path counseling, individual counseling or relationship counseling for any reason the Teacher of Zijnsoriëntatie deems appropriate. The costs will then be settled according to point 12 of Article 3.
Article 3 Terms of payment and cancellation
- Fees are listed on the page of the respective Teacher of Zijnsoriëntatie offering. Prices include VAT unless otherwise stated.
- Student must pay the invoice within 14 days of the invoice date to the Leerruimte Zijnsoriëntatie – Ronald van der Lee.
- If the payment term is exceeded, the student will receive a reminder and 7 days to still pay the invoice without any increase in fees.
- If the student does not fulfill his/her payment obligation within 7 days after the reminder, Teacher of Zijnsoriëntatie is entitled to take collection measures without further notice or to have them carried out by third parties.
- All extrajudicial collection costs shall be borne by the student.
- If the student has objections regarding the declared amount, he or she must make this known within 14 days after receipt of the original invoice at the latest, by means of a motivated written notification to the Teacher of Zijnsoriëntatie .
- Unless the contrary is expressly proven, with respect to the accuracy of what the student owes to the Teacher of Zijnsoriëntatie, the administrative records of the Teacher of Zijnsoriëntatie shall be conclusive.
- In case of payment arrears, the Teacher of Zijnsoriëntatie is entitled to suspend further supervision or participation in course, training or retreat until the payment obligation has been fulfilled.
- All disputes related to agreements between the student and Teacher of Zijnsoriëntatie, to which these terms and conditions apply, are governed by Dutch law and shall be settled by the courts.
- Individual counseling and relationship counseling can be cancelled free of charge 24 hours in advance. Thereafter, the Teacher of Zijnsoriëntatie will charge 50% of the cost.
- Missed days of participation in a course, path guidance, training or retreat cannot be deducted from the total price.
- For open enrollments, there is a 14-day reflection period during which the enrollment can be cancelled free of charge. The reflection period expires if the first learning moment has occurred.
- Participation in a course, path guidance, training can be cancelled free of charge up to one day in advance. If cancelled on the day, the cost of the first meeting is due.
- If participation in a course, path counseling, training or retreat is terminated by the student or Teacher of Zijnsoriëntatie before its end, there will be a settlement of the participation fee in proportion to participation up to the time of termination. Previously missed days will not be credited.
- Participation in a retreat can be cancelled free of charge two weeks in advance. Thereafter, accommodation costs will be charged and participation fees will be refunded.
- Leerruimte Zijnsoriëntatie – Ronald van der Lee is entitled to cancel trainings or courses in case of too few participants and other force majeure situations.
- In case of refunds, Leerruimte Zijnsoriëntatie – Ronald van der Lee applies a refund period of 14 days.
Article 4: Retention of title provided to student
- All items provided by the Teacher of Zijnsoriëntatie to student, such as practice materials, books and other items, shall remain the property of the Teacher of Zijnsoriëntatie unless ownership is expressly transferred to student.
- If Teacher of Zijnsoriëntatie has made items available to student, student is required to return them within seven days of the Teacher of Zijnsoriëntatie request to do so, or seven days after termination of the agreement, in their original condition, free of defects and complete. If student fails to fulfill this obligation, all resulting costs will be his/her responsibility.
- If student, for whatever reason, after a reminder to that effect, still fails to comply with the requirements under Article 4.1. said obligation, the Teacher of Zijnsoriëntatie is entitled to recover from student the resulting damages and costs, including replacement costs.
Article 5: Notice and termination
- Either party may terminate participation in any offering of the Teacher of Zijnsoriëntatie at any time in writing, orally and by email.
- If participation in any offering of the Teacher of Zijnsoriëntatie is terminated prematurely by the student or Teacher of Zijnsoriëntatie, student shall be liable for payment of invoices for work performed up to that time.
- The Teacher of Zijnsoriëntatie has the right to immediately terminate the supervision or supervision session if the student misbehaves, for example, threatens the Teacher of Zijnsoriëntatie or fellow students, is violent or is under the influence of substances such as alcohol and drugs. A police report may be filed. If student damages something in the Learning Space, the Teacher of Zijnsoriëntatie may send an invoice for this to replace the damaged thing.
Article 6: Intellectual Property
- The intellectual property of Zijnsoriëntatie rests with Hans Knibbe. Hans Knibbe is the founder of Zijnsoriëntatie and founder of the School for Zijnsoriëntatie.
- The (teaching) materials used in the Leerruimte Zijnsoriëntatie – Ronald van der Lee may not be published by student without prior permission from the Teacher of Zijnsoriëntatie and may not be used for purposes other than the program in question (workshops/courses/trainings/retraits/etc.).
- Copyright and copyrights to all (teaching) materials, handouts, videos, transcripts, images, logo, seal of approval, etc. are held by the School for Zijnsoriëntatie or the Leerruimte Zijnsoriëntatie – Ronald van der Lee. All materials received or provided to the student/participant are intended solely for his/her own use for the purpose of study and/or practice. You may not share these materials with third parties or publish them in any form or by any means without the prior written permission of the School for Zijnsoriëntatie or the Leerruimte Zijnsoriëntatie – Ronald van der Lee. Students are also not permitted to incorporate the methods described in these materials into their own curricula.
Article 7: The student's right to privacy
- The student’s data will be kept confidential in accordance with what is required by the AVG and in accordance with the privacy statement. Student consents that his/her data may be shared anonymously with fellow teachers of Zijnsoriëntatie for peer review and supervision purposes.
- Video and/or audio recordings may be made of course, training or retreat days. Student implicitly agrees to this by registering participation. Recordings of the course, training or retreat will be provided by the Teacher of Zijnsoriëntatie. Recording individual counseling sessions is the student’s own responsibility. All recorded files – both by the Teacher of Zijnsoriëntatie and by the student themselves – are for personal use only, to support study and/or practice. You are not allowed to share these files with third parties.
Article 8: Complaint procedure
- If student has a complaint about the professional performance of the Teacher of Being Orientation, the Teacher of Zijnsoriëntatie is happy to discuss it with student in a personal conversation. Student may submit the complaint verbally or by email ronald.vanderlee@zijnsorientatie.nl to the Teacher of Zijnsoriëntatie.
- Within one week, student will receive an acknowledgement of receipt of the complaint and within 4 weeks we will try to reach a solution. Should longer time be needed, the student will be told a new deadline within these 4 weeks.
- If student and Teacher of Zijnsoriëntatie cannot come to an agreement on the complaint, student may contact the Beroepsvereniging Leraren Zijnsoriëntatie (Professional Association of Teachers of Zijnsoriëntatie) and possibly file a complaint according to the complaint procedure.
- The Beroepsvereniging Leraren Zijnsoriëntatie (Professional Association of Teachers of Zijnsoriëntatie) makes a binding ruling for both parties. Any consequences will be followed up by Leerruimte ZIjnsoriëntatie – Ronald van der Lee by professional association set deadline.
- A complaint will be kept confidential at all times.
- A settled complaint will be kept in the appropriate file for a period of one year.
